List of Permitted Hemp (Cannabis sativa) Varieties (UPDATED)

If you're wondering about the permitted varieties of industrial hemp this year, you're in the right place. We have prepared a complete updated list of registered varieties for you. We'll also take a look at the basic legislative rules that need to be followed. We'll advise you on what to watch out for. When is the "reporting obligation" required and what is it exactly? Let's get started...

Legislation and Laws in the Czech Republic

Growing hemp plants is regulated by law in the Czech Republic in two basic forms:

1. Hemp with THC content up to 0.3%

This refers to handling exclusively hemp varieties listed in the current joint catalog of varieties (see below). The list consists exclusively of hemp types whose THC content does not exceed the permitted limit of 0.3%. No permit is required to grow these plants. If the total area of cultivated hemp does not exceed 100m2, no reporting obligation is necessary. This means free cultivation of industrial hemp in home conditions.

2. Hemp varieties with THC content above 0.3%

CAUTION - This form of cultivation is subject to strict regulatory measures and controls. This type of hemp can be grown by scientific institutions, schools, some state organizations, research institutes, or licensed medical cannabis suppliers. Such a handling permit is issued by the Ministry of Health. All facilities must also possess a license granted by the State Institute for Drug Control.

What is a reporting obligation?

The reporting obligation applies exclusively to persons growing hemp with up to 0.3% THC content, where the total plant area exceeds 100 m2. The Czech Customs Administration oversees compliance with all requirements for growing hemp of such an area.

As part of the reporting obligation, the grower is required to provide the relevant customs office with all information about the hemp, including data on cultivation, harvest, or removal of industrial hemp, depending on the current vegetation phase of the plants. The reporting obligation based on the handling permit, all details and requirements are discussed in Section 29 of the Addictive Substances Act. The full text can be found here.

List of Registered Cannabis Sativa Varieties

The following list of varieties represents Hemp varieties with THC content lower than 0.3%, which are registered and therefore legal, when complying with the aforementioned legislative measures, for free cultivation and use within the EU. The joint catalog of varieties is issued within the Official Journal of the European Union, with the current version dating from 1.12.2020.

If a grower cultivates varieties from this catalog, it guarantees a legal hemp type. In case of control, the grower can provide a certificate. Control may also involve testing the variety. There are many varieties on the market that meet legal limits but are not yet listed in this variety catalog.

Varieties are listed alphabetically:
