Hemp Cultivation Law in 2022
Cannabis is a regulated substance in the Czech Republic, even though it comes from nature. Legal regulations distinguish between industrial hemp and marijuana based on THC content. Knowing current legislation is crucial – violating rules leads to penalties ranging from fines to imprisonment.
How Many Cannabis Plants Can I Legally Grow?
The law explicitly prohibits growing cannabis with THC content higher than 1%. This threshold is set by Act No. 167/1998 in §24.
Key difference:
- Industrial hemp (THC up to 1%) – cultivation permitted with restrictions
- Marijuana (THC above 1%) – cultivation prohibited
Industrial Hemp Cultivation
Industrial hemp with low THC content may be grown without a permit if the area does not exceed 100 m². For larger areas, customs office notification is required.
Marijuana Cultivation – 1 to 5 Plants
A widespread misconception claims that up to 5 plants carry no penalties. The opposite is true – it is an offense. A small amount of marijuana does not mean legality, only milder sanctions. Unauthorized cannabis cultivation for personal use always violates the law.
